Respected Sir/Madam,

I am the resident of DLF Valley situated in at Bhagwanpur Village, Sector-3, Kalka-Pinjore Urban Complex, Panchkula.
         All residents of the DLF Valley are facing the high/over voltage supply, which has potential to damage the home electrical appliances like AC, TV, Fridge, lights etc. In fact, when the AC was made to stop working by the Electronic Voltage Stablizer, the residents called the technician who measured the voltage supply and told that during day time the electric supply was 254 Volts and at night it reaches the level of around 270 Volts. All electronic appliances are on the verge of damage, which can also be life threatening.
     Some residents had met the concerned officials of DLF the construction company and JLL the maintenance agency of the DLF Valley and the residents are given to understand the requisite work in this regard is required to be carried out by the UHBVN.
    Therefore, you are requested to forthwith take necessary action in the matter, failing which the UHBVN and the concerned officials of the DLF/JLL will be responsible for any loss to the residents, including threat to life.

Why Should Allottees be Beware of Agents of Builder?

FIRST HAND EXPERIENCE OF A LAWYER REPRESENTING THE RESIDENTS/VICTIMS OF BUILDER:
My clients from Gurgaon told me about a ploy adopted by all builders. And, its very important to residents to know it, that’s why I m sharing it. The builders always put its agents in the campus, for taking control of the resources of township. Agents are of below mentioned types:
(1) FREE ALLOTTEES, the top most Govt. Officers who matter in Govt. and facilitate the smooth completion of project;  are paid indirect bribes in the way of Free of Cost allotments or at Nominal Rates. Such Govt. officers are those persons who are/were instrumental in facilitating the illegal certificates/approvals/licences to the Builder, by compromising the quality in the constructions. 

(2) THE BRAND AMBASSADORS Some prominent faces enjoying influence and respect in society are employed by the builder for not only selling the houses, but also for influencing the residents at different stages; like getting elected the men of builder in the governing body, balancing the unrest of residents in the face of unfair trade practices adopted by builder etc. 

(3) HOUSES ALLOTTED TO ITS OWN EMPLOYEES


(3) Other gullible and innocent residents are lured and trapped by by the aforesaid 3 types of the agents of builder, for serving the interests of builder.

All the aforesaid persons are planted in the township, primarily, for 2 purposes:
     (1)   For controlling the resources of township
     (2)   For controlling the aggression of the residents for unfair trade practices.

             The aforesaid agents of the builder acts on the instructions of the builder and from time to time help the builder in multiple ways, like by praising the facilities provided by builder, praising the quality of material used, by drawing the attention of residents on less important issues while sidelining the major issues, by forming multiples RWAs, by filing cases in collusion with the builder and later entering into compromises, by discrediting the residents who cant be compromised or convinced by the builder etc. least but not last. Capturing of RWA is one of the steps to help the builder.

The exploitation by the builder can be thwarted only by the aware residents.

Cracks in the Floor of DLF Valley

Respected Sir/Madam,
This is in continuation of my earlier e-mails about the deficiencies in the Property No. DVF-C/3-50/SF. With great sadness and pain I have to inform you that after possession various patterns of cracks have been detected almost in all masonry walls and beams of my house, which may turn the property dangerous and make the housing unfit for occupation.
At the time of giving possession, on my pinpointing the cracks in the beams of balcony and at some other places were repaired. However, not less than two months of possession, the occurrence of crack has been visually detected again in the several location on the building such as wall, the beams of balcony. Some cracks are found near the door frame. At several locations near the roof, have experienced vertical and horizontal cracks. Some are active cracks and some others appears as dormant cracks.
It appears that cracks have been possibly caused by inadequate foundation bearing capacity, improper dimension of beam and column of the structure in second floor and/or the shrinkage of wall. At the cost of repetition I do wish to point-out that some walls does not appears to follows the simple standard formula of construction, i.e, 90 degree structure of walls, as the walls clearly appear to have curves at different places.
Even, the Electric and Water Line Layout is prima-facie  defective. I would be happy if the DLF could supply me the drawings of Electric and Water Line Layout
I am given to understand by the experts of civil engineering in circle that there are many possibilities that cause wall cracks. These could be the inappropriate building structure capacity, foundation problem such as inadequate foundation load bearing capacity and swelling soil and shrinkage in building material. The cause of crack can be one or combination among those factors. The cause of cracks may also be the upper structure problem. And, all these structural defects appears the result of violation of PWD Code and Building Code by the DLF.
Further, there are lot of hollow defective tiles including wooden tiles. Let me remind you the Annexure-V (Tentative Specifications) of the Floor Buyer Agreement, on which the DLF relies upon like a Holy Book, which says:
Ø   Walls would have Plastic Emulsion
Ø  Ceiling of house including the ceiling of staircase with Oil Bound Distemper (OBD)
Ø  Flooring with vitrified tiles
All walls except kitchen wall are without Plastic Emulsion. Ceiling of house including the ceiling of staircase is without Oil Bound Distemper (OBD). And, I doubt, the quality of alleged vitrified tiles.
If the independent penal of experts is appointed the malpractices and deficiencies running throughout the property would be detected with ease. And, if my grievance is not resolved; I will constrained to pray the court to appoint the team of independent Local Commissioners/Experts to verify the claims of the DLF about quality of works

         Today, i.e. on 23.04.2017, one person namely Satish Gupta Contractor visited my house in connection with the deficiencies pointed through earlier series of earlier e-mails. After inspection of my property he replied to me that he would not be unable to cure the aforesaid defects. And, he appears right in replying so; because the structural evaluation and additional soil investigation, Building Drawings and all other deficiencies are required to be thoroughly examined by the experts to assess the structural building capacity, foundation bearing capacity, soil swelling potential etc. and to chekc the fulfilment of the Specifications of the ANNEXURE V of the Floor Buyer’s Agreement.
       The DLF needs to investigate the cause of the cracks and to evaluate whether the building structure remains safe in supporting its service load. The quality of concrete and the quality of steel bar, the crack record, building material, soil data, built drawings etc. needs to be assessed and re-analyzed in order to have clear information about the cause of cracks.
            On earlier occasions also I told you in clear terms that I don’t love to drag personal issues to the Courts; but a law knowing person like me cant and should not tolerate cheating; in which the DLF has been indulging from the very inception. Therefore, with due respect, you are hereby called upon to send the team of expert persons to remove the deficiencies of my property, i.e. C-3/50-SF.

It is submitted as under:
(1)        That I am the the resident of DLF Valley,_________; situated at Village – Bhagwanpur, Kalka-Pinjore Urban Complex, Sector – 3, Panchkula.
(2)        That the DLF, a builder of the DLF Valley, before handing-over the possession of the Independent Floors had taken the considerable amount from the residents/allottees in the name of ‘RESIDENT WELFARE ASSOCIATION’/‘VALLEY RESIDENTS WELFARE SOCIETY’. I had also paid the aforesaid amount and same has been deducted from the account of the undersigned. However, the whereabouts and other details of the aforesaid society are not known to anyone. And, despite the repeated requests of the residents/allottees the DLF has failed to provide even the basic information, i.e., office and names and addresses of the office bearers, accounts details etc.
The matter involves the appropriation of the hard-earned money of the residents/allottees. Therefore, you are requested to provide below mentioned information to me:

(i)                Memorandum and the Bye-laws submitted of society.
(ii)              Copy of the List of members of the Society along with address
(iii)            Copies of all the Resolutions/Special Resolutions for utilising the amount of society.
(iv)     The copy of the ledger showing consolidated and separate account of all items of receipt and expenditure;
(v)     Certified copy of the complete voucher’s file, containing all vouchers for contingent and other expenditure incurred by the Society.
If I don’t get the aforesaid information within 7 days of receipt of this E-mail, then I will presume that the amount paid be me in the favour of resident welfare society is being dishonestly misappropriated and thus criminal breach of trust is being committed in collusion with the DLF’s owners/Directors and other concerned officials.
